Participation in the environmental permit: how does it work?

An omgevingsvergunning (environmental permit) is the municipality's permission to build, renovate, demolish or change the use of a property. Under the Dutch Environment Act, the municipality asks with your application whether and how you involved the surroundings. For most applications participation is not legally mandatory, but it is desired and often decisive for smooth handling. Only for an out-of-plan environmental activity (BOPA) or municipality-designated cases can the council make participation mandatory.

The simplest way to do this well is a tidy, documented residents' letter: you inform the immediate surroundings about what you're going to do, when, and where they can go with questions. That reduces the chance of objections and records that and how you carried out participation, exactly what you can show later.

What's the difference between a bewonersbrief and an omgevingsbrief?
They're the same thing: a letter informing neighbours about your (re)building plans. 'Bewonersbrief' is the common term; some call it an omgevingsbrief or buurtbrief.
Does participation reduce the chance of objections or planning damage?
Good, early participation reduces the chance of objections because neighbours feel heard. It also records that and how you informed them, useful if a view or objection is nonetheless filed later.
What is an omgevingsvergunning (environmental permit)?
An omgevingsvergunning is the municipality's permission to build, renovate, demolish or change the use of a property. Under the Environment Act you apply for it via the Omgevingsloket; many small works are permit-free. If you are (re)building, participation is often part of it, and so is a residents' letter.
What does an omgevingsvergunning cost?
The municipality charges fees (leges) that differ per municipality and project type, usually a percentage of the build costs. What we charge is separate: the residents' letter is billed per campaign, based on the number of neighbours around your parcel.
What is the objection period for an omgevingsvergunning?
After a permit is granted there is usually a six-week objection or appeal period in which interested parties can respond. Early participation with a documented residents' letter reduces the chance it gets that far and strengthens your position if a view or objection is filed anyway.
What is planning damage (planschade) with an omgevingsvergunning?
Planschade is the loss (e.g. reduced property value) neighbours may suffer from a permit or plan change; they can request compensation for it. Informing neighbours early and properly via a residents' letter takes away concerns and makes the process more predictable.
What are the submission requirements for an omgevingsvergunning?
Which documents you must supply depends on the type of activity: drawings, a site sketch, calculations and, where applicable, evidence of participation. We handle that last part, stating whether and how you involved the surroundings, with a correct, documented residents' letter.
What is a principeverzoek (preliminary request)?
With a principeverzoek you informally test with the municipality whether your plan is viable before you file the full application. If it comes back positive, it's wise to bring the surroundings along early; a residents' letter is the logical first step.
